Can an NRI in the US Make a Valid Will for Assets in India?

Yes. An NRI in the US can make a valid will that covers assets in India. The will has to be in writing, signed by the will-maker, and witnessed by two people who saw the signing. Where you live does not take that right away.

The risk is a will that looks fine in the US but misses a step India expects. It builds on our broader wills and succession guidance and the earlier comparison of having a will versus none.

What Makes a Will Made in the USA Valid in India?

A will made in the USA is valid in India when it follows the rules that apply to the Indian property it covers. Land and buildings in India are generally governed by Indian rules even if you sign in the US. So aim for a document that satisfies both countries.

That means an adult of sound mind, a clear written statement of who gets what, a signature, and two witnesses. Name each asset by type, location and account details.

How Should an NRI Sign and Witness a Will From Abroad?

Sign the will in front of two witnesses at the same time. Each witness should watch you sign, then sign in your presence. Use people who will not receive anything under the will, because a witness who also benefits can put that gift at risk.

Use your name exactly as on your passport. Add the date and place, and initial each page.

Does an NRI Will Need to Be Notarized, Registered or Attested?

None of these is the test of validity, but each can help. A US notary confirms who signed and when. Registration in India is optional, though some families choose it for extra proof. Some Indian consulates will attest a will in person, so check your local consulate before assuming.

For example, the Consulate General of India in Chicago lists in-person attendance, two local witnesses who are not family, and registration on its portal. Requirements differ by region, so read your own consulate page. Where papers must travel, an apostille from the state office may also be needed, as the Chicago and Washington pages explain. See our document verification guide.

Should an NRI Make One Will or Two for the US and India?

Many families sign two wills, one for US assets and one for India assets. Each should say it covers only assets in its own country and should not cancel the other. That avoids the common problem of a later will accidentally wiping out the earlier one.

Ask a US estate lawyer and an Indian advocate to read both together. For trusts and planning across generations, see trusts and estate planning.

What Does a Will Control and What Passes Outside It?

A will controls only what you own in your sole name. Several routes pass assets outside it: a bank nominee, a joint holding, or an insurance policy with a named beneficiary. These can point to different people than your will does.

What Happens After an NRI Will-Maker Passes Away?

After the will-maker dies, the executor gathers the death certificate, locates the original will, and checks whether a court grant is needed. Some cities, including Kolkata, can require probate before the will is used for property there. Elsewhere it may be optional.

Heirs outside India can later move money abroad within RBI limits. RBI's FAQ lists up to USD 1 million per financial year for inherited assets, with taxes paid. Learn more in our guide to cross-border money rules and the West Bengal probate walkthrough.

What Does This Look Like in Practice? A Hypothetical Example

Consider a hypothetical illustration with invented names. Neha, a US resident, owns a flat in Kolkata and an Indian savings account. She signs a will at home in front of two neighbors, has it notarized, and names her cousin in Kolkata as executor.

She also updates the bank nominee and keeps the original in a labeled folder. Her cousin knows where the papers are. None of the people or events here are real.

Which Mistakes Make an NRI Will Fail?

  • Naming a witness who also receives a gift.
  • Leaving the bank nominee unchanged and unaligned with the will.
  • Writing two wills that cancel each other.
  • Describing property vaguely, without location or account details.
  • Keeping the original where no one in India can find it.

Frequently Asked Questions

Can an NRI make a will for property in India?

Yes. An NRI can make a will for Indian assets from anywhere. It must be written, signed, and witnessed by two people who saw the signing.

Is a will made in the USA valid in India?

Often yes, if it meets the signing and witness rules that apply to the Indian property. Have advisors in both countries check it.

Does an NRI will need to be registered in India?

No. Registration is optional for validity. Some families register for extra proof of authenticity.

How many witnesses does a will need?

Two is the standard minimum. Each should watch you sign and then sign in your presence.

Can a beneficiary be a witness to the will?

Best avoided. A witness who also receives a gift can lose that gift. Pick people who gain nothing.

Do I need a US notary for a will meant for India?

Not for validity, but it helps. A notary confirms who signed and when, which Indian offices and banks often want.

Can the Indian consulate attest my will?

Some consulates do, often in person with two local witnesses. Check your own consulate's page first.

What is an apostille and does my will need one?

An apostille certifies an official's or notary's signature for use abroad. Whether you need one depends on who will rely on the will.

Should I make one will or separate wills for India and the US?

Many families use two coordinated wills, each limited to one country, so neither cancels the other.

Can I leave my Indian bank account in my will?

Yes, but the bank may first look at the nominee on record. Keep the will and nomination consistent.

What is the difference between a nominee and an heir?

A nominee receives the asset to hold. An heir is who the will or law says finally owns it. They can differ.

Does joint ownership override my will?

Often yes. An asset that passes to the surviving joint holder may sit outside the will. Review how each asset is titled.

Who should I name as executor of an India will?

Someone in India who is reliable and willing to handle court and office visits. Name a backup too.

Is probate required for an NRI will in India?

It depends on where the property sits. In some cities, including Kolkata, it can be required. Elsewhere it is often optional.

Can my family in India contest my will?

Yes, anyone with a legal interest can challenge it. Clear witnessing and consistent paperwork make that harder.

What if I lose the original will?

Keep the original safe and tell the executor where it is. A lost original can cause delay, though courts sometimes accept proof of its contents.

Can my heirs send inherited money to the United States?

Generally yes, within RBI's rules. RBI's FAQ allows up to USD 1 million per financial year from inherited assets, with taxes paid.

Does a will avoid all Indian taxes for my heirs?

No. A will decides who gets assets, not whether tax applies on later sales or income. Plan that separately.
