A Look Out Circular can stop an NRI at immigration on arrival in India. This guide explains who issues LOCs, what types exist, how to find out if one has been issued against you, and the exact legal process to challenge or remove it.
A Look Out Circular stopped a Kolkata-origin software engineer at Chhatrapati Shivaji Maharaj International Airport in 2024. He had lived in New Jersey for eleven years. He had no idea an LOC existed against him until the immigration officer's screen lit up and two CISF personnel appeared at his side.
That scenario is not unusual. In 2024, Indian authorities issued over 1.1 lakh Look Out Circulars — a 34% increase from 2022. Many NRIs discover an LOC exists only when they attempt to enter or exit India.
What Is a Look Out Circular?
A Look Out Circular (LOC) is a written notice issued by an Indian authority directing immigration officials at airports, seaports, and land borders to watch for, alert, or detain a named individual. The Bureau of Immigration maintains the LOC database.
There are two types of LOC:
Watch LOC (Open LOC): The immigration authority is directed to alert the issuing agency when the named person arrives or departs. The person is not automatically detained but the issuing authority is notified immediately.
Detain LOC: The immigration authority is directed to stop and detain the person. An NRI arriving in India with a Detain LOC will be held at the airport until the issuing authority sends officers to take custody.
The distinction matters enormously. A Watch LOC gives an NRI a window to contact their advocate before authorities arrive. A Detain LOC means immediate custody on landing.
Who Can Issue a Look Out Circular in India?
The power to issue an LOC is not restricted to courts. Multiple agencies can issue one, often without prior judicial oversight:
State and Central Police: Any officer of the rank of Superintendent of Police or above can issue an LOC in connection with a cognisable offence.
Central Bureau of Investigation (CBI): Issues LOCs in cases under its jurisdiction, including corruption, economic offences, and cases transferred by court order.
Enforcement Directorate (ED): Issues LOCs in FEMA violation cases and PMLA (Prevention of Money Laundering Act) investigations.
Income Tax Department: Can issue LOCs in cases involving tax evasion above specified thresholds.
Courts: Criminal courts can direct the Bureau of Immigration to issue or maintain an LOC as part of bail or trial proceedings.
Ministry of Home Affairs (MHA): Can issue LOCs directly in matters of national security or public order.
What Happens to an NRI When an LOC Is Active?
On attempting to land in India: When the NRI's passport is scanned at immigration, the LOC flag appears on the officer's screen. For a Detain LOC, the NRI is escorted away from immigration and held in a secure area. For a Watch LOC, the immigration officer stamps the passport and simultaneously notifies the issuing agency.
On attempting to depart India: An NRI already in India and attempting to leave may also be stopped. Departure LOCs are issued in cases where courts or agencies want to prevent a person from leaving before a matter is resolved.
Passport validity is unaffected: An LOC does not automatically invalidate a passport. In serious cases, the issuing authority may separately apply for passport impoundment under Section 10 of the Passports Act 1967, which is a separate process.
How to Find Out If a Look Out Circular Has Been Issued Against You
There is no public portal where an NRI can check LOC status. Methods NRIs use to check:
Right to Information (RTI) application: An advocate in India can file an RTI application to the Bureau of Immigration or the State Police seeking confirmation of whether an LOC exists. RTI responses must come within 30 days.
Advocate enquiries through official channels: An experienced advocate can make enquiries through the Police Control Room, court records, or directly with the issuing authority in cases where the underlying complaint is known.
Court records: If the LOC is connected to pending litigation, the court file may contain references to it.
The practical advice for any NRI with a pending dispute or complaint in India is to have an advocate check for LOCs before booking a flight to India.
Grounds on Which a Look Out Circular Can Be Issued
The Central Government's 2010 guidelines specify that an LOC can be issued where the person is accused or suspected of an offence punishable with imprisonment of three years or more, and there is reasonable suspicion that they may flee India or avoid investigation.
In practice, LOCs have been issued in:
- IPC/BNS offences including murder, theft, cheating, and criminal breach of trust
- Section 498A (matrimonial cruelty) cases
- FEMA violations and ED investigations
- Income tax evasion matters
- Court-directed LOCs where an accused has failed to appear
The Supreme Court in Sumer Singh Salkan v. Assistant Director and Others (2010) laid down guidelines requiring that LOCs not be issued mechanically and that the right to travel under Article 21 be respected. This judgment is the foundational authority for all High Court challenges to LOCs.
How to Challenge or Remove a Look Out Circular in India
Step 1: Written representation to the issuing authority
A formal written representation to the agency that issued the LOC, setting out why the LOC was wrongly issued — lack of grounds, absence of a cognisable offence, or resolution of the underlying complaint.
Step 2: Writ petition in the High Court under Article 226
If the representation is rejected or ignored, a writ petition is filed in the relevant High Court. The constitutional basis is Article 226 read with Articles 19(1)(a) and 21 (right to travel as part of personal liberty).
The petitioner must establish:
- That an LOC exists and affects their right to travel
- That the LOC was issued without adequate grounds or due process
- That the continuation of the LOC causes irreparable harm
Step 3: Interim relief — stay of the LOC
Simultaneously with the writ petition, the petitioner can apply for interim relief staying the operation of the LOC. Courts have granted interim stays within days in urgent matters where the petitioner can show an imminent need to travel.
Step 4: Final hearing and removal order
The court examines the grounds on which the LOC was issued, the issuing authority's response, and the petitioner's right to travel. Courts have quashed LOCs entirely or modified them to Watch LOCs.
How Long Does LOC Removal Take?
In urgent matters where interim relief is obtained, an NRI can get a court order within 1-3 weeks of filing. For complete writ proceedings to conclude, the timeline is typically 3-9 months. The key is to act immediately on discovery of the LOC.
Can You Travel Internationally While an LOC Is Active?
An LOC issued by Indian authorities only affects entry into and exit from India. It has no effect on travel between other countries. An NRI in the USA can travel to the UK, UAE, or anywhere else without any LOC-related restriction. The LOC only activates when the NRI attempts to pass through Indian immigration.
Interpol has a stated policy of rejecting Red Corner Notice requests from India for matrimonial offences including Section 498A (now Section 85 BNS 2023). For most NRI criminal matters, the risk is India-specific.
The Relationship Between LOC and Anticipatory Bail
An LOC and anticipatory bail operate in parallel. An NRI who secures anticipatory bail under Section 482 of the BNSS 2023 before travelling to India is protected from arrest on arrival — but a Detain LOC can still result in temporary detention at immigration until the bail order is produced.
The recommended approach for any NRI with a pending FIR and a suspected LOC is to:
- Obtain a copy of the anticipatory bail order in India before travel
- Have the advocate physically present at the airport or available by phone on arrival
- Challenge the LOC separately through High Court writ proceedings to get it removed entirely
Frequently Asked Questions
What is a Look Out Circular (LOC) in India?
A Look Out Circular is a notice issued by Indian authorities to immigration officials at airports and border points directing them to watch for, alert about, or detain a named individual. The Bureau of Immigration maintains the central LOC database. A Detain LOC results in immediate custody on arrival. A Watch LOC alerts the issuing authority without mandatory detention.
Who can issue a Look Out Circular in India?
A Look Out Circular can be issued by State Police (SP rank and above), the CBI, the Enforcement Directorate, the Income Tax Department, the Ministry of Home Affairs, and by courts as part of criminal proceedings. Each issuing authority submits the LOC to the Bureau of Immigration, which implements it at all points of entry and exit.
Can an LOC stop an NRI from entering India?
Yes. A Detain LOC will result in an NRI being stopped at immigration on arrival and taken into custody. A Watch LOC will alert the issuing authority without immediate detention. The type of LOC determines whether the NRI is arrested on landing or simply flagged.
Does a Look Out Circular affect international travel outside India?
No. An LOC issued by Indian authorities only operates at Indian airports, seaports, and land borders. It has no effect on travel between other countries. It is entirely distinct from an Interpol Red Corner Notice, which circulates internationally.
How does an NRI find out if a Look Out Circular has been issued against them?
There is no public portal to check LOC status. An NRI can find out through an RTI application filed by an advocate to the Bureau of Immigration or State Police, through advocate enquiries at the relevant police station, or through court records where the LOC is connected to pending litigation.
What is the difference between a Watch LOC and a Detain LOC?
A Watch LOC directs immigration officials to alert the issuing authority when the named person arrives or departs — without mandatory detention. A Detain LOC directs officials to stop and hold the person until the issuing authority sends officers. The distinction determines whether the NRI is detained on arrival.
Does Interpol act on Indian LOCs for 498A matrimonial cases?
No. Interpol has a stated policy of rejecting Red Corner Notice requests from India for matrimonial offences including Section 498A (now Section 85 BNS 2023). An NRI facing a 498A case is not at risk of international arrest through Interpol, though an Indian LOC can affect travel to India specifically.
How is a Look Out Circular challenged in the High Court?
A Look Out Circular is challenged through a writ petition under Article 226 of the Constitution in the relevant High Court, based on Articles 19 and 21 which protect the right to travel as part of personal liberty. The petitioner must show the LOC lacks adequate grounds or due process. Courts can grant interim stays and final removal orders.
How long does it take to remove a Look Out Circular through the High Court?
Interim relief staying the operation of an LOC can be obtained within 1-3 weeks in urgent matters. Full writ proceedings typically take 3-9 months to conclude. Early action significantly improves timelines.
Can anticipatory bail protect an NRI from a Look Out Circular?
Anticipatory bail protects an NRI from arrest but does not remove an LOC from the immigration database. An NRI with anticipatory bail may still be temporarily held at immigration if a Detain LOC exists, until the bail order is produced. The LOC must be separately challenged through High Court writ proceedings for complete removal.
Can an LOC be issued in a property or matrimonial dispute?
An LOC is technically a measure in criminal proceedings. However, where a civil dispute such as a property fraud or matrimonial matter has a criminal complaint running alongside it, an LOC can be issued in connection with the criminal aspect. Civil courts themselves cannot directly issue LOCs.
Can a Look Out Circular be issued without notifying the person?
Yes. There is no requirement under current Indian law that the person named in an LOC be notified of its issuance. NRIs frequently discover LOCs only when they arrive at an Indian airport. This is a well-documented problem and one of the grounds on which courts have criticised the mechanical issuance of LOCs.
What is the Supreme Court's position on Look Out Circulars and Article 21?
The Supreme Court in Sumer Singh Salkan v. Assistant Director (2010) held that LOCs affect the fundamental right to travel under Article 21 and must not be issued mechanically. Courts must examine whether the grounds for the LOC are reasonable and proportionate. This judgment is the foundational authority for all subsequent High Court challenges to LOCs.
Can the Enforcement Directorate issue a Look Out Circular?
Yes. The Enforcement Directorate can issue LOCs in FEMA violation investigations and PMLA (Prevention of Money Laundering Act) cases. ED-issued LOCs are common in cases involving alleged foreign exchange fraud, unaccounted foreign remittances, and hawala transactions.
What happens to an NRI's passport when a Look Out Circular is active?
An LOC does not automatically affect passport validity. However, in serious cases, the issuing authority may separately apply for passport impoundment under Section 10 of the Passports Act 1967. Passport impoundment is a separate process requiring a specific order and can be challenged independently through the Passport Authority or courts.
